An injured passenger who escaped death in a fatal Fanling bus crash that killed six in 2019 filed a petition to the High Court on Thursday, seeking compensation from the bus driver and KMB.
The claimant is Wong Pui-yan, and the bus driver Man Chi-kwong and KMB Co. Ltd. are listed as the respondents. The hearing has been scheduled for October 7.
Wong stated in the writ that she sustained injuries in a traffic incident at Fanling Highway on December 18, 2019, because of Man's negligent driving and added Man's employer, KMB, should also be held accountable for the incident.
Yet, Wong didn't state in the writ how much compensation she was seeking.
The fatal incident occurred around 4.20pm that day as the double-decker bus crashed into the curb and headed straight into the trees. Half of the upper deck was torn away, and parts of the roof hung on the trees as some passengers were thrown from the bus.
Three men and three women were killed, and 38 other passengers sustained injuries.
In April last year, Man pleaded guilty to dangerous driving causing deaths and dangerous driving causing grievous bodily harm. As a result, the District Court jailed him for four years and suspended his driving license for five years.
Man was also ordered to pay for and complete a Driving Improvement Course.
